This is one of the burning question that is asked by most of our clients and is one of the biggest concern of a person looking to form a limited liability company. How much time would it take to form a company?
There is no guaranteed time frame which can be provided as it involves processes at the Registrar of Companies (ROC for short) which being a government organisation do not provide a concrete or guaranteed time frame in which all the processes would be undertaken. Also, the time process at ROC also depend on the work load at ROC Office as their manpower is not flexible in short term.ROC processing time has reduced drastically after digitization of the whole process and is very efficient in processing the documents received by them, however, as mentioned earlier the processing time is also dependent on the work load at ROC Office.
However, we are providing a time schedule which is generally taken to the whole company formation process to be completed if there is no resubmission of documents to ROC due to any clarification / amendment required by the ROC. So this is the shortest time required to form the company in an normal working process (we have formed company even in shorter time, but during those time the ROC work loads would be very low).
Provided below are the steps to be undertaken for Company Formation and the shortest time required for them in normal course of business.
- Director Identification Number (DIN) – Apply & Get DIN No. – 1-2 days
- Name Approval – Apply & Get Name Approval Letter – 3-4 days
- Get Certificate of Incorporation – File MOA & AOA, pay fee and get COI – 3-4 days
The days mentioned above are working days, the ROC works 5 days a week.
We generally provide our clients a time-frame of 15days for the completion of whole process keeping around 4-5 days toward contingency if ROC may require resubmission of any forms, delay in providing documents by the clients etc.
